Employment-Based Immigration: Second Preference EB-2

For those foreign applicants that can demonstrate that they are members of a profession holding an advanced degree or its equivalent or a foreign national who has exceptional ability. 

If applying for the advanced degree criteria, the candidate must apply for a job that requires an advanced degree and possess such degree, among other requirements specified on the labor certification. 

The exceptional ability must show the ability in science, arts or business, and recognition in this achievement. 

There is another special category for which you could be considered eligible and consists if you are of national interest for the United States. Foreign applicants seeking national interest waiver are requesting that the Labor Certification be waived because it is in the interest of the United States.

National interest waivers are usually granted to those who have exceptional ability and whose employment in the United States would greatly benefit the nation. 

Those seeking a national interest waiver do not need an employer to sponsor them.
